Immunity and code of conduct

Parliament’s authorization is required for the detention or prosecution of members
Yes, except for flagrant delicto

Notes: When caught in the act of committing a felony, no leave is required. As of 2019 MP immunity has been limited to political actions only. Leave to prosecute is detailed in the Hellenic Parliament Standing Orders. A request from the Public Prosecutor’s office to prosecute an MP is submitted to the parliament via the Minister of Justice. The request is referred from the Speaker of parliament to the Committee of Parliamentary Ethics, which invites the MP to a hearing. The committee examines whether the action is related to the MP's political or parliamentary activity. In such cases, the committee denies the leave to prosecute. The committee’s report must be reasoned. The committee may request from the government the supply of all documents necessary for its' decision. Petitions for a waiver enter the order of the day of the plenum following the submission of the committee’s report. A new petition for a waiver based on the same actual facts is not acceptable.
